Terms of Service

These Terms of Service ("Terms") govern your access to and use of the JobLink platform ("Platform"), operated by Kingdom Workforce LLC, a Texas limited liability company, doing business as JobLink ("Company," "we," "us," or "our"). By accessing or using the Platform, you ("User," "you," or "your") agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. Definitions

• "Platform" means the JobLink web application at joblinkplatform.com, including all features, APIs, and services provided through it.
• "Admin User" means an authorized representative of a staffing agency who accesses the Platform to manage candidates, job orders, and campaigns.
• "Candidate" means an individual whose information is stored or managed within the Platform by an Admin User.
• "AI Assistant" means the AI-powered chat assistant ("Tom") integrated into the Platform.
• "SMS Campaigns" means text message communications sent to Candidates through the Platform via third-party messaging services.

2. Eligibility and Account Access

The Platform is designed for use by staffing agencies and their authorized personnel. By using the Platform, you represent that:

• You are at least 18 years of age.
• You are authorized by a staffing agency to access and use the Platform on its behalf.
• You will keep your login credentials secure and will not share them with unauthorized individuals.
• You are responsible for all activity that occurs under your account.

We reserve the right to suspend or terminate any account at our sole discretion if we believe these Terms are being violated.

3. Platform Services

JobLink provides staffing agencies with tools for:

• Managing candidate databases (names, contact information, skills, work history)
• Creating and managing job orders and staffing pipelines
• Sending SMS blast campaigns and individual messages to candidates
• Generating candidate interest via magic links
• Generating candidate resumes
• Querying platform data via the AI Assistant (Tom)

We may modify, update, or discontinue any feature of the Platform at any time without prior notice.

4. SMS Campaign Responsibilities

The Platform provides SMS functionality through third-party providers. By using SMS features, you acknowledge and agree that:

• You are solely responsible for obtaining and maintaining valid, documented consent from each Candidate before sending any SMS communication, in compliance with the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and all applicable federal, state, and local laws.
• You will honor all opt-out requests promptly and will not send messages to Candidates who have opted out.
• You will not use the SMS features for spam, harassment, deceptive messaging, or any purpose unrelated to legitimate staffing operations.
• You will maintain records of consent sufficient to demonstrate compliance with applicable laws.
• Company provides the SMS delivery mechanism but does not verify consent and is not responsible for your compliance failures.

You agree to indemnify and hold Company harmless from any claims, fines, penalties, or damages arising from your SMS campaigns, including TCPA violations.

5. AI Assistant Usage

The AI Assistant (Tom) is provided to help Admin Users query platform data using natural language. By using the AI Assistant, you acknowledge that:

• AI-generated responses are informational only and may contain errors, omissions, or inaccuracies. You should independently verify any critical information before acting on it.
• The AI Assistant processes queries using third-party AI services. Your queries and the data referenced in responses may be transmitted to these services for processing. See our Privacy Policy for details.
• The AI Assistant does not provide legal, employment, or compliance advice.
• We do not guarantee the availability, accuracy, or completeness of AI Assistant responses.
• You will not attempt to manipulate, jailbreak, or misuse the AI Assistant for purposes outside its intended function.

6. Data Accuracy

You are responsible for the accuracy, completeness, and legality of all data you input into the Platform, including Candidate information. Company does not independently verify Candidate data and is not liable for decisions made based on inaccurate data in the Platform.

7. Acceptable Use

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable law or regulation.
• Upload or transmit malicious code, viruses, or harmful data.
• Attempt to gain unauthorized access to any part of the Platform, other accounts, or systems connected to the Platform.
• Reverse engineer, decompile, or disassemble any portion of the Platform.
• Use automated scripts, bots, or scraping tools to access the Platform outside of provided APIs.
• Resell, sublicense, or redistribute access to the Platform without written authorization.
• Use Candidate data for purposes unrelated to legitimate staffing operations.
• Transmit discriminatory, harassing, or threatening content through the Platform.

8. Intellectual Property

The Platform, including its design, code, features, documentation, and branding, is the intellectual property of Kingdom Workforce LLC. These Terms do not grant you any ownership rights in the Platform. You retain ownership of the data you input into the Platform.

9. Availability and Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KINGDOM WORKFORCE LLC, ITS OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising out of or related to your use of the Platform, regardless of the theory of liability.

In no event shall our total aggregate liability exceed the amounts paid by you to Company in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Kingdom Workforce LLC and its officers, directors, members, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Platform.
• Your violation of these Terms.
• Your violation of any applicable law or regulation, including TCPA and employment laws.
• Any claim by a Candidate or third party related to your SMS campaigns, data handling, or staffing practices.

12. Termination

We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Upon termination:

• Your right to access the Platform ceases immediately.
• We may retain or delete your data in accordance with our Privacy Policy and applicable law.
• Sections 4 (SMS Responsibilities), 8 (IP), 9 (Warranties), 10 (Limitation of Liability), 11 (Indemnification), and 13 (Governing Law) survive termination.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Texas, and you consent to the personal jurisdiction of such courts.

14. Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated via the Platform or email. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Company regarding your use of the Platform and supersede all prior agreements and understandings.
